Company collects the personal information identified in the “Categories of Personal Information Collected” section for the purposes identified in table column “Business Purposes and Commercial Purposes for Collecting that Personal Information” and retains it for the period described in section “How Long We Keep Your Personal Information”. Do We Use Cookies
Yes. Cookies are small files that the Site or our service provider transfers to your computer’s hard drive through your Web browser that enables the Site’s or service provider’s systems to recognize your browser and capture and remember certain information. Web Beacons

No Sale or Sharing of Personal Information
We do not sell or share your personal information, where “share” means disclosing personal information to third parties for cross-context behavioral advertising. Without limiting the foregoing, we have not, and have no actual knowledge that we have, sold or “shared” the personal information of individuals of any age, including the personal information of children under 16, in the last 12 months.
How Long We Keep Your Personal Information
We retain your personal information for 12 months after our last interaction with you. We will retain personal information longer as necessary to comply with legal, administrative, or procedural requirements, for example, a litigation hold.

Right to Know
California Consumers have the right to submit a verifiable request for specific pieces of their personal information and for information about Company’s collection, use, and disclose of their personal information. Please note that the CPRA’s right to obtain “specific pieces” does not grant a right to the whole of any document that contains personal information, but only to copies of items of personal information. Moreover, California residents generally just have a right to know categories, for example, categories of third parties to which personal information is disclosed, but not the individual third parties.

- California Consumers have the right to submit a verifiable request for deletion of their Personal Information that Company has collected from the Consumer.

- California Consumers have the right to submit a verifiable request for the correction of inaccurate personal information maintained by Company, taking into account the nature of the personal information and the purposes of processing the personal information.
Note on Sensitive Personal Information
Company does not infer characteristics from sensitive personal information. Company only uses sensitive personal information as necessary to perform the services or provide the goods the average person would reasonably expect when requesting those goods or services, to ensure security and integrity, short term transient use, to maintain the quality of our products and services, or for other purposes permitted by the California Privacy Rights Act and implementing regulations (“CPRA“) without the right to opt out.
How to Exercise Your Rights
Company will respond to requests in accordance with applicable law if it can verify the identity of the individual submitting the request. California Consumers can exercise their rights in the following ways:

Requests by Authorized Agents
An authorized agent can make a request under the CPRA on the California Consumer’s behalf by submitting a request to know or a request to delete according to the instructions set forth in Section “How to Exercise Your Rights” above. When an authorized agent submits a request to know or a request to delete on the consumer’s behalf, the business may require the consumer to, among other things: (a) provide the authorized agent with a written and signed authorization;(b) verify the identity directly with the us; or (c) directly confirm with us that consumer provided the agent authorization to submit the request. In the alternative, a power of attorney compliant with the California Probate Code can be provided.
How We Will Verify Your Requests
If you submit a request through an adequately secure password-protected account that you created before the date of your request, we will use the authentication mechanisms in the account to verify your identity. Otherwise, we match personal information that you provide us against personal information we maintain in our files. The more risk entailed by the request (e.g., a request for specific pieces of personal information), the more items of personal information we may request to verify your identity. If we cannot verify your identity to a sufficient level of certainty to respond to your request, we will let you know promptly and explain why we cannot verify your identity.
The Company’s Non-Discrimination Policy
California Consumers have the right not to be subject to discriminatory treatment by Company for exercising their privacy rights under the California Privacy Rights Act, and Company will not discriminate on that basis.
Your ‘Do Not Track’ Browser Setting
The Site does not collect personally identifiable information about your online activities over time and across third-party websites or online services. We do not support the Do Not Track (DNT) browser setting. DNT is a preference you can set in your browser’s settings to let the websites you visit, including the Site, know that you do not want the sites collecting your personally identifiable information.

We provide links to third party websites operated by organizations not affiliated with Company. We do not disclose your Personal Information to organizations operating such linked third-party websites. Minors Under 13 Years of Age
We respect the privacy of children. Our Services are not designed to attract an audience younger than thirteen (13), and we do not knowingly collect Personal Information from children under thirteen (13). If you are under the age of thirteen (13), you are not permitted to use our Services and should not send any information about yourself to us through the Services. Changes To This California Privacy Policy

Biometric Information Privacy Policy
Biometric systems, including but not limited to biometric timeclocks or timeclock attachments, are used by Peak Technical Staffing, USA and Peak Technical Services, LP (together referred to as the “Company”), the Company’s vendors, subvendors, customers, master service providers, and/or licensors of time and attendance software used by any or all of them through which biometric data is collected. Biometric timeclocks are computer-based systems that scan an individual’s unique physical characteristics such as a finger or face for purposes of identification. The computer system extracts unique data points and creates a unique mathematical representation used to verify the individual’s identity, for example when an employee arrives at or departs from the workplace. This policy explains what information may be collected, how it may be used or disclosed, how it is stored and safeguarded, how long it is retained, and when it is disposed of.
Biometric Data Defined
In this policy, biometric data means “biometric identifiers” and “biometric information” as those phrases are defined under applicable biometric information privacy laws. “Biometric identifier” includes but is not limited to data generated by automatic measurements of an individual’s biological characteristics, including but not limited to, a fingerprint, voiceprint, retina or iris scan, or scan of hand or face geometry, or body temperature. “Biometric information” refers to any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual.
Collection of Biometric Data and It’s Purpose
The Company, its vendors, subvendors, customers, master service providers, and/or licensors of time and attendance software used by any or all of them collect, capture, obtain, store, and use biometric data for the following purposes: verification of identity, preventing fraud, timekeeping, ensuring that all hours worked are accurately recorded, and for recording and tracking of an individual’s time worked and attendance. The Company will not sell, lease, trade or otherwise profit from an individual’s biometric data.
Disclosure
Since the Company, its vendors, subvendors, customers, master service providers, and/or licensors of time and attendance software used by any or all of them collect, capture, or otherwise obtain biometric data, to the extent required under applicable law such as the Illinois Biometric Information Privacy Act, 740 ILCS § 14/1, et seq. the Company first:
- Will inform the individual that the Company, its vendors, subvendors, customers, master service providers, and/or the licensors of time and attendance software used by any or all of them are collecting, storing, capturing, or otherwise obtaining the individual’s biometric data;
- Will inform the individual of the specific purposes and length of time for which the biometric data is being collected, stored, and used; and
- Will receive a written release signed by the individual authorizing the Company, its vendors, subvendors, customers, master service providers, and the licensors of time and attendance software used by any or all of them, to collect, store, and use the individual’s biometric data for the specific purposes disclosed by the Company.
The Company will not disclose, redisclose, or otherwise disseminate an individual’s biometric data that is in its possession unless:
- the individual consents to such disclosure or redisclosure to the extent allowed by law;
- the disclosure or redisclosure completes a financial transaction requested or authorized by the individual;
- the disclosure or redisclosure is required or permitted by applicable law; or
- the disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.
Retention Schedule
The Company will collect, obtain, store and use an individual’s biometric data only until, and will request that its vendors, subvendors, customers, master service providers, and the licensors of time and attendance software used by any or all of them, permanently destroy such data when, the first of the following occurs:
- The initial purpose for collecting or obtaining such biometric data has been satisfied, such as the termination of an employee’s employment with the Company; or
- Within three years of the individual’s last interaction with the Company or such shorter period of time required under applicable law.
An individual’s biometric data that is in the possession of the Company will be permanently destroyed by the Company under these guidelines except as otherwise required by law or legal process such as a valid warrant or subpoena issued by a court of competent jurisdiction.
Data Storage, Transmission, and Protection
The Company will store, transmit, and protect from disclosure biometric data that is in its possession using the reasonable standard of care within its industry. Such storage, transmission, and protection from disclosure will be performed in a manner that is the same as or more protective than the manner in which the Company stores, transmits, and protects from disclosure other confidential and sensitive information of the Company and its employees. These safeguards include firewalls, physical and digital security measures, encryption, access restrictions, password authorization, system logging, and file backup.
